asked the Minister for Social Welfare the reason for the delay in the appeal hearing of a person (details supplied) in County Louth; and when this appeal will now be heard in respect of the person's disability benefit.

The person concerned was paid disability benefit to 1 August 1987 after which date payment was disallowed following examination by a medical referee of the Department who expressed the opinion that he was capable of work. He appealed against the disallowance of benefit and in accordance with normal procedures he was referred to a different medical referee on 17 September 1987 who also expressed the opinion that he was capable of work. The appeals officer now proposes to hold an oral hearing of his claim on 7 December 1987.

asked the Minister for Social Welfare the reason unemployment assistance has been disallowed to a person (details supplied) in Dublin 8 who has exhausted his entitlement to unemployment benefit and who is at present only working 18 hours per week, part time in a temporary position.

For the purpose of a claim to unemployment assistance a person is not deemed to be unemployed on any day on which he works for wages or other remuneration.

The person concerned claimed unemployment assistance on 25 August 1987. His claim was disallowed by a deciding officer on the grounds that he was not unemployed from that date. He is employed for six days a week from 7 to 11 o'clock each evening and is insured at class A rate of PRSI.

He has been informed of the decision and of his right to appeal should he wish to do so.
