asked the Minister for Defence the reason for the delay in continuing payment of an Army disability pension to a person (details supplied) in County Galway.

Limerick West): The person referred to was awarded a disability pension under the Army Pensions Acts in respect of disablement due to injury. He subsequently received a lump sum payment for the same injury in settlement of a civil claim. The Army Pensions Acts provide that where compensation is received after the award of any such pension, the award may be reviewed and, having regard to the amount of such compensation, the pension may be either terminated or reduced. As the annual value of the compensation in this case, assessed on an actuarial basis, exceeded the appropriate rate of pension under the Army Pensions Acts, payment of pension has been withheld.
