asked the Minister for the Environment if a premises (details supplied) in County Dublin will be demolished by the local authority to allow for the Kilcock, Maynooth and Leixlip by-pass, County Kildare, now that the tenants have been housed by the local authority; when the demolition will take place; in the meantime if his Department or the local authority will indemnify the owners of the premises against all loss including loss of income from tenants from the time the tenants were moved out, damage to premises by squatters or otherwise because the premises are now vacant, claims for compensation by injured parties or otherwise in respect of loss or claims that might arise, against which it is not possible to insure because the premises are vacant; and if he will make a statement on the matter.

asked the Minister for the Environment if his Department is ready to enter into negotiations to purchase a premises (details supplied) in County Dublin which will have to be demolished to allow for the Kilcock, Maynooth and Leixlip by-pass, County Kildare; and, in the event of his Department not purchasing these premises immediately and squatters taking up residence, because the premises has been emptied by the local authority, if he will take responsibility for having the squatters housed by the local authority; and if he will make a statement on the matter.

I propose to take Questions Nos. 75 and 76 together.

The property in question is included in the Kildare County Council (Kilcock, Maynooth, Leixlip By-Pass) motorway scheme and is described as property which the local authority proposes to acquire for the purpose of constructing the proposed motorway.

On 17 June 1988 I made an order approving the motorway scheme. The timing of construction of this route has been considered in the context of the preparation of a draft blueprint for road development which has just been completed. I will be making a statement relating to the blueprint shortly.

Negotiations for the purchase of the property, referred to by the Deputy, including the level of compensation, and arrangements for the transfer of ownership are matters for settlement between the local authority and the owner in the first instance. Pending completion of a transfer of ownership, security of the premises is a matter for the present owner.
