asked the Minister for the Environment if it is proper procedure for a member of a local authority who has been an under-bidder on property offered for sale by the local authority to subsequently attempt to influence the decision of the local authority on the disposal of the property.

Section 33 of the Local Government (Planning and Development) Act, 1976, (as amended by section 8 (2) of the Local Government (Planning and Development) Act, 1982) contains the provisions governing the position of a member of a planning authority who has an interest in relation to the acquisition or disposal of land by that authority whether under or for the purposes of the Local Government (Planning and Development) Acts or any other enactment. The interpretation of the law is a matter for the courts.
