asked the Minister for Labour the progress, if any, which has been made to have funds distributed to the former employees of a company (details supplied) in County Waterford from the fund asset/pension plan through Irish Pensions Trust Ltd.

My Department have received two separate applications under the Protection of Employees (Employers' Insolvency) Act, 1984 for payment of arrears of pension contributions in respect of the year prior to the date of insolvency of the group of companies involved.

A question arose regarding the interpretation of section 7 of the 1984 Act, under which the actuarial certificates were submitted for the processing of the applications. This has been resolved following receipt of legal advice on the matter.

However, explanations concerning the calculation of the amounts claimed, i.e. £191,691.93 is one case and £17,679.80 in the other, are awaited from the receiver of the group of companies and the trustees of the pension schemes. The receiver indicated recently that the trustees and himself wished to meet the officials involved in my Department to discuss the applications. My Department are endeavouring to arrange a meeting at the earliest possible date. I am hoping that the information requested will be supplied either at the meeting or very soon thereafter, so that the examination of the applications can be completed and payments issued by my Department with the minimum delay.
