Vol. 384 No. 6

Written Answers. - Extradition Act.

63.

asked the Minister for Justice the number of persons extradited to the United Kingdom to date under the terms of the Extradition Act, 1965; and the offences for which they were charged.

I am informed by the Garda authorities that their records show that from 1 January 1969 to date a total of 895 persons have been extradited to the United Kingdom. The figures for the period between 1965 and 1969 are not readily available from Garda records.

I am not in a position to provide the information sought in the second part of the question because until recently it has not been the practice for the Garda authorities to monitor the charges brought against persons following their extradition to other jurisdictions. However, such information is being compiled in respect of persons extradited in the current year for the purposes of the report the Government is required to make to the Oireachtas in accordance with section 6 of the Extraditon (Amendment) Act, 1987.

64.

asked the Minister for Justice the numbers of persons extradited to the United Kingdom to date under the terms of the 1987 Act; and the number of applications which have been received to date from the United Kingdom authorities under the terms of the 1987 Act.

It is not correct to speak of persons being extradited to Britain or Northern Ireland or of applications being received from those jurisdictions under the terms of the Extradition (Amendment) Act, 1987. These matters continue to be governed by the relevant provisions of Part III of the Extradition Act, 1965. The provisions of the Extradition (Amendment) Act, 1987, will, of course, apply to certain applications received from those jurisdictions. For the purposes of my reply, I am assuming that the Deputy is seeking figures for the number of applications received to which the provisions of the Extradition (Amendment) Act, 1987, apply and the number of persons extradited on foot of such applications.

Warrants have been received in respect of five persons to whom the provisions of the Extradition (Amendment) Act, 1987, apply. One of the persons has been returned to Britain in accordance with an order of the District Court made under section 47 of the 1965 Act. In addition, warrants in respect of a further six persons were received and subsequently recalled by the requesting authorities. The 1987 Act provisions applied to two of these cases, and the warrants in respect of the remaining four were recalled before there was an opportunity to establish whether the provisions of the 1987 Act applied.
