87.

asked the Minister for Social Welfare the present position regarding the appeal against disallowance of disability benefit in the case of a person (details supplied) in County Kerry.

Payment of disability benefit to the person concerned was disallowed from 25 May 1988 following examination by a medical referee who expressed the opinion that she was capable of work.

She appealed against the disallowance and was examined by a different medical referee on 2 November 1988 who found her to be incapable of work from that date.

Payment of benefit was restored from 25 May 1988 and all benefit payable to date has been issued.

88.

asked the Minister for Social Welfare when an invalidity pension will be granted to a person (details supplied) in County Kerry.

Invalidity pension has been awarded to the person concerned with effect from 15 September 1988. Pension books payable from 12 January 1989 have been issued to the designated post office of payment. Arrears of pension due from 15 September 1988 to 11 January 1989, less the amount of disability benefit paid during this period, will be issued by payable order to the person concerned as soon as possible.

asked the Minister for Social Welfare the number of County Sligo resident persons who, during the years 1987 and 1988, have been receiving unemployment assistance or unemployment benefit or registered for such at labour exchanges in County Sligo or other labour exchanges in adjoining counties and who ceased receiving or registering because they had left the area.

91.

asked the Minister for Social Welfare the number of County Leitrim resident persons who, during the years 1987 and 1988, have been receiving unemployment assistance or unemployment benefit or registered for such at labour exchanges in County Leitrim or adjoining counties and who ceased receiving or registering because they had left the area.

It is proposed to take Questions Nos. 89 and 91 together.

The number of people who ceased receiving unemployment benefit or unemployment assistance because they had left the area is not known.

90.

asked the Minister for Social Welfare if he will consider restoring disability benefit to a person (details supplied) in County Cork.

Payment of disability benefit to the person concerned was disallowed from 28 November 1987, following an examination by a medical referee who considered him to be capable of work. He appealed this decision, and was examined by a different medical referee on 4 February 1988, who also considered him to be capable of work.

The person concerned was notified of the result of this examination and was supplied with a form on which to set out the grounds for an appeal if he wished his case to be referred to an appeals officer for determination. He did not return this form and his appeal was withdrawn. He submitted a final medical certificate, certifying that he was fit to resume work on 11 February 1988.

He claimed disability benefit again from 4 June 1988. As he had not resumed work since February, and there was no change in his incapacity, payment of benefit was suspended, pending the outcome of another medical referee examination. On 21 September 1988, he was examined by the medical referee, who considered him to be capable of work from 4 June 1988.

The person concerned did not exercise his right of appeal against this decision within the specified 21 days. As he has not furnished medical evidence of incapacity since 23 September 1988, the claim has now been terminated.
