asked the Minister for the Environment if he will outline legislation, sections of legislation and regulations concerning the planning, construction and maintenance of roads, which have been passed by the Houses of the Oireachtas but not yet brought into force; and if he will make a statement on the matter.

All legislative provision concerning construction and maintenance of orders are in force apart from section 60 of the Civil Liability Act, 1961. This section would provide that a road authority shall be liable for damage caused as a result of their failure to maintain adequately a public road. I wish to refer the Deputy to my reply to Question No. 36 of 9 March 1989 of the Official Report — columns 440-441 — regarding the reasons for the section not being brought into operation.
