asked the Minister for Health if he intends to terminate the General Medical Service contracts of the general practitioners who have not accepted his new capital payment scheme; and if he will make a statement on the matter.

As the Deputy is I am sure aware, the High Court recently gave a decision in the action taken by Dr. Mary Grehan regarding the terms and conditions of the 1972 GMS contract. My Department are currently reviewing the implications of that decision. The High Court decision gave leave to either party to return to the court with a further submission and evidence, should that be necessary.

Having regard to such possibility, it would be inappropriate for me to comment any futher on the matter at this time.
