asked the Minister for Labour whether any legislation sponsored by his Department and passed by the Houses of the Oireachtas requires the issuing of ministerial regulations before becoming fully operational; the date of the passage of any such legislation; and the present position regarding the preparation of the regulations required.

The legislation sponsored by my Department which has been passed by the Houses of the Oireachtas but which still potentially requires the making of ministerial regulations before becoming fully operational are as follows:

Protection of Employees (Employers' Insolvency) Act, 1984

Section 1 (3) of this Act includes a provision which would enable the Minister to make regulations. The power to make these regulations has not yet been invoked and the legal implications of doing so are under current examination.

Safety, Health and Welfare (Offshore Installations) Act, 1987

This piece of legislation, enacted on 22 July 1987, requires the making of ministerial regulations before becoming operational. Four sets of regulations for the purpose of bringing the Act into operation are at an advanced stage of drafting. When these regulations are drafted, the Act will be brought into operation by order and the regulations subsequently made.

Safety, Health and Welfare at Work Act, 1989

This Act was signed by the President on 19 April 1989. I am making arrangements to have it operative at an early date and necessary regulations will subsequently be made.
