Vol. 390 No. 4

Written Answers. - Pornographic Video Tapes and Magazines.

65.

asked the Minister for Finance if he is satisfied with the adequacy of the law in regard to the seizure of pornographic or indecent video tapes and magazines; and if he will make a statement on the matter.

It is assumed that the Deputy has in mind the law relating to the seizure by Customs and Excise Officers of imported pornographic or indecent video tapes and magazines.

Under the Customs Acts, indecent or obscene articles including video tapes and magazines are prohibited to be imported and are liable to seizure by Customs and Excise officers. The importation of magazines which are the subject of a prohibition order under the Censorship of Publications Act, 1946, is also prohibited and such magazines are also liable to seizure. I am informed by the Revenue Commissioners that the Customs and Excise staff exercise care in enforcing these prohibitions and that no difficulties have been encountered in applying the law where irregular importations are detected. I am satisfied that the law is adequate in this regard.
