Written Answers. - Guidelines for Aliens Section.

asked the Minister for Justice if he will publish all internal guidelines in use by the aliens section of his Department relating to the admission of aliens to the State from the date of the foundation of the State to this date; and the present procedures and criteria applicable to obtain permission to reside in the State.

The admission and subsequent stay of aliens in the State is governed by the Aliens Act, 1935, and orders made under that Act, that is, the Aliens Orders, 1946 to 1988, and the European Communities Act, 1972, and the regulations made thereunder, namely the European Communities (Aliens) Regulations, 1977 to 1985.

The provisions outlined are administered by immigration officers at the point of admission in regard to persons coming from a place outside Great Britain or Northern Ireland. Aliens coming from Great Britain or Northern Ireland are not subject to control on admission but, also under the legislation, are required to report their presence to the relevant registration officer.

As regards permission to reside in the State, I would refer the Deputy to my response to a Dáil question by Deputy Howlin on Thursday, 23 June 1988 in which I outlined the procedures whereby a person can apply for and obtain such permission.

There are no guidelines in use in the aliens division of my Department concerning admission or permission to reside other than the provisions contained in the legislation I mentioned.
