asked the Minister for Finance the reason for the dismissal from the Office of Public Works of a person (details supplied) in County Kerry; when and from whom the complaint was received about the said person; whether the person received notification in writing about the reasons for his dismissal; and if his decision is final.

Following receipt of information about irregularities on the part of certain workers at a construction site in County Kerry, the Office of Public Works carried out an investigation. In the course of the investigation every available worker at the relevant site was interviewed. Arising from the investigation the person named was suspended from duty on full pay pending the outcome of a disciplinary hearing. As a result of the disciplinary hearing he was dismissed.

The reason for his dismissal was his involvement in irregular practices during working hours.

The information in question was given to the office on a confidential basis some weeks before the formal investigation was initiated. The person named was given the reason for his dismissal at the disciplinary hearing at which his union representative was present.

The decision is final. The person named has been made aware of his rights under the Unfair Dismissals Act.
