asked the Minister for Agriculture and Food if his Department have received representations from solicitors acting on behalf of a person (details supplied) in County Donegal regarding a milk quota in respect of lands held by this person; if it is intended to reply to these; the position in regard to a milk quota transferred on the leasing of land on the death of the lessor; and if he will make a statement on the matter.

My Department have received the representations referred to and a reply has now issued.

Under the regulations on the quota system, quota can transfer under a land leasing transaction if the lease is for a minimum period of three years. In this case as the lease of land is for a period of three years from 1 April 1987, the quota transfers to the benefit of the lessee up to 31 March 1990. On 1 April 1990 the quota reverts to the lessor or on her death to the next of kin.
