asked the Minister for Health if his attention has been drawn to the fact that the Midland Health Board during the period July 1977 to January 1989 operated the drugs refund scheme on the basis of refunds in excess of £33 per month instead of the £28 per month prescribed under the scheme and that, as a result of this practice, many chronically ill people availing of the scheme were under-refunded in their entitlements; and if he will take steps to ensure that the Midland Health Board makes good these underpayments to the people concerned.

The Midland Health Board operated an administrative charge of £5 for processing applications for drugs refunds in the period July 1987 to January 1989. The board withdrew these charges at my request in January 1989. However, as there was no statutory inhibition to the charge, the Midland Health Board inform me that the question of refunding payments made for periods prior to January 1989 does not arise.
