asked the Minister for the Marine if his attention has been drawn to the fact that a person (details supplied) in County Waterford is being threatened with prosecution because he was found in possession of a monofilament net which he uses only for gillnet fishing and which should not constitute a fishing offence; and if he will examine the matter.

I am advised that proceedings are being taken by the Southern Regional Fisheries Board against the person in question. The decision to prosecute was one for resolution by the board and I have no function in the matter. It is a matter for the courts to determine whether or not an offence has been committed.
