asked the Minister for Social Welfare if he will arrange for the return of a pension book and a living alone allowance to a person (details supplied) in County Leitrim.

The person concerned is currently in receipt of an old age non-contributory pension at the rate of £50 per week. This is the maximum rate of pension, and is appropriate to a person with means of less than £6 per week.

It was decided by a deciding officer on 26 October 1989, following an investigation by the local social welfare officer, that the person concerned no longer satisfied the statutory conditions for receipt of living alone allowance, as his son was living with him. Accordingly, the pensioner was requested to return his pension book, so that the payment of the living alone allowance could be terminated. A new pension book, excluding the living alone allowance, issued to the pensioner on 31 October 1989.

asked the Minister for Social Welfare when an appeal will be heard in the case of a person (details supplied) in Cork who has had his disability benefit terminated.

The person concerned was paid disability benefit to 4 June 1989, after which date payment was disallowed following examination by a medical referee who expressed the opinion that he was capable of work. He appealed the disallowance of benefit and was examined by a different medical referee on 11 July 1989 who also considered him capable of work.

The person concerned requested that his case be submitted to an appeals officer for determination and stated in his notice of appeal that he would submit further medical evidence. A letter issued to the person concerned on 13 September advising him that no further evidence had been received.

Medical evidence was submitted in mid-October and the case was forwarded to an appeals officer who proposes to hold an oral hearing of the claim. The person concerned will be advised of the date, time and place of the hearing as soon as arrangements are finalised.
