asked the Minister for Health if he has considered the judgments of the High Court in a case (details supplied) regarding the appointment of the Chief Executive Officer of Beaumont Hospital, Dublin 9 at a time when no quorum existed for the board to appoint him; whether the appointment was valid; and whether he considers it necessary to bring in legislation to ratify retrospectively all the decisions made by the Chief Executive Officer during the period from February to to October, 1988.

The issue raised by the Deputy was commented on by the court but did not form part of any judgment. Should any particular circumstances arise requiring action by me, I will take whatever measures may be necessary.
