Vol. 394 No. 4

Written Answers. - Social Welfare Benefits.

151.

asked the Minister for Social Welfare the reason an invalidity pension has not been paid to a person (details supplied) in County Cavan; and if he will make a statement on the matter.

Invalidity pension is payable to insured persons who satisfy the contribution conditions and who are permanently incapable of work.

The person concerned was examined on 12 September 1989 by a medical referee who did not consider her to be permanently incapable of work and asked to have her referred for a further examination in nine months. A deciding officer decided that she was not, therefore, entitled to invalidity pension

As the person concerned is dissatisfied with this decision, arrangements have been made to have her examined by a different medical referee on 15 January 1990. Her entitlement to invalidity pension will be reviewed in the light of the report of this examination.

152.

asked the Minister for Social Welfare the present position regarding an application for an old age non-contributory pension made by a person (details supplied) in County Cork.

Following investigation of the case, a deciding officer decided on 8 December 1989 that the person concerned is not entitled to pension as she failed to establish that her means do not exceed the statutory limit and failed to provide evidence of her age.

153.

asked the Minister for Social Welfare if he will arrange to have a social welfare officer call to a person (details supplied) in County Cork to investigate his contribution record and entitlement to the maximum rate of pension; and if his attention has been drawn to the fact that the person concerned is still not satisfied with the findings of his Department.

Arrangements have been made to have a social welfare officer call to the person concerned. On completion of the necessary inquiries a report will be furnished to a deciding officer who, if appropriate, will review the rate of pension in payment.

154.

asked the Minister for Social Welfare if he will reconsider a pension application made by a person (details supplied) in County Cork; and if his attention has been drawn to the fact that this person has very little means and is a small farmer.

The person concerned appealed against the decision of a deciding officer to revoke his old age non-contributory pension with effect from 26 May 1989 as his means were deemed to have exceeded the statutory limit.

Following an oral hearing of his case an appeals officer upheld his appeal and his pension was reawarded with effect from 26 May 1989 at the total weekly rate (which includes an adult dependant allowance in respect of his wife) of £36.90 increasing to £39.10 with effect from 28 July 1989 in accordance with budgetary increases. A payable order book is being issued immediately to his local post office and all arrears due will be issued without delay.

155.

asked the Minister for Social Welfare when payment for a dependant will be made to a person (details supplied) in County Cork in respect of one of her children.

The claimant is at present in receipt of payment for the dependent child in question at the rate of £12.90 per week. Arrears of £90.30 which are due will issue by payable order within two weeks.
