Question:

47 Mrs. Owen asked the Minister for Justice when he will introduce an amendment to the Animals Act, 1985 to allow local authorities to recover the costs of transporting and impounding a wandering animal prior to the release of that animal, noting that a request for such a change has been made by Dublin County Council to his Department.

Section 4 (5) of the Animals Act, 1985, authorises the recovery of the cost of transporting animals to the pound as a simple contract debt in any court of competent jurisdiction. However, it has been represented to me that the Act should be amended to enable these costs to be recovered before the release of the animals. Any proposals I may have in this regard will be announced in the normal way in due course.
