Written Answers. - Transfer of Family Homes.

Question:

62 Mr. Flanagan asked the Minister for Justice if his attention has been drawn to certain difficulties being experienced under the Family Home Protection Act, 1976, where the prior written consent of a spouse must be given to any transfer of the family home; if he accepts that where there has been a transfer of a family home without any objection from the other spouse for a period of six years, then such conveyance should no longer be deemed to be null and void and that evidence of any consent by the spouse or supporting evidence for any such consent should no longer be required; and if he will make a statement on the matter.

The Law Reform Commission has made a recommendation on this matter, (LRC 30-1989) examination of which is proceeding as quickly as possible, having regard to the other demands on my Department's resources.
