Question:

11 Mr. Quinn asked the Minister for the Environment if his attention has been drawn to the fact that some private landlords, renting out furnished flats in the Dublin area, have given notice to quit to tenants with newly born children, or have refused accommodation to families with children; if he is prepared to take any action to deal with this problem in view of the rising housing crisis; and if he will make a statement on the matter.

As I indicated earlier this year in dealing with a similar question, the letting of a dwelling is at the discretion of the landlord and the terms on which the dwelling is let are a matter for agreement between a landlord and the tenant. Where a landlord wishes to recover possession of a dwelling, the terms of the tenacy agreement and the provisions of the landlord and tenant code could apply.
