153 Mr. R. Bruton asked the Minister for the Environment whether he is concerned that attempts to impose planning conditions designed to secure reasonable restoration of a listed building in the context of commercial redevelopment of the site has proved unsuccessful; and if he will make a statement on the matter.

154 Mr. R. Bruton asked the Minister for the Environment whether he has satisfied himself that the current powers of listing buildings for preservation in a development plan gives adequate powers to preserve our architectural heritage; and if he will make a statement on the matter.

I propose to take Questions Nos. 153 and 154 together.

Appropriate powers are available under the Local Government (Planning and Development) Acts, 1963 to 1990 to facilitate the preservation of buildings of artistic, architectural or historic interest. The Acts provide for the attachment of conditions in relation to development permissions, including conditions relating to the preservation of listed buildings and interiors but the validity of such conditions will depend on the particular circumstances of each case. In particular, conditions must be expedient for the purposes of or in connection with the authorised development.
