33 Mr. Cotter asked the Minister for Industry and Commerce if he has satisfied himself that purchasers of imported cars from Japan have access to an adequate supply of spare parts for these vehicles; and if he will make a statement on the matter.
There is no legal requirement that traders or suppliers have to carry supplies of spare parts for goods in which they deal.
However, the Sale of Goods and Supply of Services Act, 1980 does provide that in a contract for the sale of goods there is an implied warranty that spare parts and a adequate after sale service will be made available by the seller in such circumstances as are stated in an offer, description or advertisement by the seller on behalf of the manufacturer or on his own behalf and for such period as is so stated or, if no period is so stated, for a reasonable period.
I would add that neither I nor the office of the Director of Consumer Affairs and Fair Trade have received any complaints about the adequacy of supplies of spare parts for imported Japanese cars.
