Question:

126 Mr. J. Mitchell asked the Minister for Justice whether it is a policy in the Carriage Office to refuse persons PSV licences on the basis that they are already working; if so, if he will give the rationale for this policy; and if he will make a statement on the matter.

The conditions governing the grant of a PSV licence are prescribed in the Road Traffic (Public Service Vehicle) Regulations. An applicant who is already in employment may be granted a PSV licence provided the Garda Commissioner is satisfied that the applicant is not engaged in any occupation which, in the opinion of the commissioner, is likely to impair his efficiency or to conflict with his responsibilities or to be incompatible with his employment as a driver of a small public service vehicle. In addition, an applicant must, in accordance with the regulations, give an undertaking that he will be available for at least 40 hours per week to drive a small public service vehicle.

In the event of a refusal by the Garda Commissioner to grant a PSV licence, the applicant is told why his application is being refused and is informed that he has a right of appeal to the District Court.
