Question:

157 Mr. Byrne asked the Minister for the Environment the reason there can be two differing policies relating to the responsibilities of local authorities in respect of water supplies to residential property with specific reference to the case of a person (details supplied) in Dublin 6; and if he will outline where responsibility lies for the repair of a water main in this case.

Generally, the law provides that pipes connecting any premises to a public water main are the property of the owner or occupier of the premises, and the latter are accordingly responsible for such pipes. However, under the Local Government (Dublin) Act, 1930, Dublin Corporation and Dún Laoghaire Corporation may agree, to maintain branch water pipes to any premises within their functional areas. This provision does not apply to Dublin County Council.

The matter has been noted for consideration in the context of the revision of sanitary services legislation.
