Written Answers - Disability Benefit Appeal.

Question:

89 Mr. Ellis asked the Minister for Social Welfare the present position regarding the disability benefit appeal of a person (details supplied) in County Leitrim which was to have been held two months ago.

The person concerned was examined by a medical referee on 13 November 1990 and was deemed to be capable of work following which payment of disability benefit was discontinued. He appealed against this decision to the independent social welfare appeals office and he was referred for a further medical examination by a different medical referee on 22 January 1991 when he was again deemed to be capable of work. Subsequently representations were received on his behalf concerning the extent of his illness, as a result of which the appeals officer deemed it necessary to have further medical inquiries carried out. The case has, therefore, been referred for a further examination by a medical referee which will take place shortly. When the result of this examination is available to the appeals officer, the appeal will be determined promptly.
