Written Answers. - County Kilkenny Haulage Licence Application.

Question:

67 Mr. Aylward asked the Minister for Tourism, Transport and Communications if he will arrange to have a haulage licence issued, without further delay to a person (details supplied) in County Kilkenny.

On 30 September 1988 the person concerned applied for a road freight carrier's licence. Every applicant for such a licence must satisfy the EC requirements of good repute, appropriate financial standing and professional competence. To satisfy the professional competence requirement, an applicant must be the holder of a certificate of competence or employ a transport manager who is the holder of such a certificate to continuously and effectively manage his haulage business.

The applicant was fully informed on a number of occasions of the necessary requirements to complete his application. Since these were not produced since the date of application, it was decided to treat the application as lapsed.

In this case, the applicant claims to have been a haulier in the UK but did not produce a certificate of competence from the authorities there. There is no provision in the legislation whereby the person named could be granted a certificate of competence on this basis. However, the applicant could satisfy the competence requirement by employing a transport manager who holds a certificate of competence or by obtaining an Irish certificate of competence through passing the appropriate examination conducted by the Chartered Institute of Transport.
I cannot grant a road freight carrier's licence until he makes a new application satisfying the necessary requirements outlined above.
