Written Answers. - Unfair Dismissals.

Question:

32 Mr. Spring asked the Minister for Labour if he proposes to allocate resources to enable the Employment Appeals Tribunal to publish an up-to-date volume of decisions in unfair dismissal cases; and if he will make a statement on the matter.

The position is that reports of important decisions of the Employment Appeals Tribunal were prepared and published in respect of the early years of operation of the Unfair Dismissals Act, 1977. I understand that, while the intention had been to continue with such reports, this, in fact, did not happen because of more pressing demands on the resources of the tribunal.

The reality today is that important decisions of the tribunal are widely publicised either in the media or in specialist publications like Industrial Relations News. The previous reports which were prepared did not sell well and, therefore, were little used.

I am informed that a number of private individuals/organisations have expressed an interest from time to time in the preparation of the type of information the Deputy appears to have in mind. I would be pleased to give any possible assistance to any persons or bodies who would now be interested in undertaking this work on a commercial basis.

I am also aware that the Federation of Irish Employers have recently publishedUnfair Dismissal — Cases and Commentary by Declan Madden and Tony Kerr which examines the decisions of the tribunal in this area since 1977.
Copies of all decisions of the Employment Appeals Tribunal under the Unfair Dismissals Act are, of course, available for inspection at the offices of the tribunal.
