Written Answers. - Liability for Capital Acquisiton Tax.

Question:

107 Mr. Garland asked the Minister for Finance whether his attention has been drawn to the situation where separated persons in a second relationship who are joint owners in their family home and where one partner wills their part of the home to the other the surviving member of the partnership is liable to pay capital acquisitions tax; if he will outline his proposals to rectify this matter; and if he will make a statement on the matter.

As the Deputy is aware this matter was raised in the Finance Bill debates this year. At that time I expressed my sympathy for the difficulties faced by couples in this situation and I promised that officials of my Department would study the matter positively although I pointed out that it is a difficult and complex area. In this context, the White Paper on Marital Breakdown is due to be published in the near future and this will help develop public debate on this issue.
