Question:

96 Mr. Ferris asked the Minister for Social Welfare if he will outline the action required by a person (details supplied) in County Tipperary in her application for unemployment assistance to prove that her means were less than £5,408; and if he will make a statement on the matter.

The claim of the person concerned for unemployment assistance was disallowed on the grounds that she failed to furnish evidence that her means did not exceed the statutory limit, which in her case is £5,408 per annum. She appealed this decision to the independent social welfare appeals office. The case was listed for oral hearing on 25 June 1991. However, the person concerned was not available for the hearing as she was working in the Isle of Man at this time. The appeals officer made a summary decision on her case on the basis of the evidence available and disallowed her appeal.

The person concerned reactivated her claim on 7 October 1991, giving her uncle's home as her permanent residence. Her file was forwarded to the social welfare officer for reinvestigation. To date the social welfare officer has made several unsuccessful attempts to contact the person concerned at her uncle's address and at her original home address which is nearby.

A further attempt will be made to contact the person concerned. If this fails, she will be asked, in writing, to attend for interview at a time and place suggested by the social welfare officer.
