Written Answers. - Social Welfare Benefit.

Question:

151 Mr. Durkan asked the Minister for Social Welfare if an invalidity pension is payable to a person (details supplied) in County Kildare; and if he will make a statement on the matter.

Invalidity pension is payable in place of disability benefit to people who satisfy the appropriate contribution conditions and who are regarded as permanently incapable of work.

The person concerned has been in receipt of disability benefit since 29 December 1988 and claimed an invalidity pension on 26 August 1991. He was examined by a medical referee of the Department on 8 October 1991 who expressed an opinion that he was incapable of work, but not permanently incapable. He was informed of this decision, and of his right of appeal, on 3 December 1991.

There is no trace of an appeal having been received from him. The Deputy's question is now being accepted as an appeal and the case is being referred to the independent social welfare appeals office. In connection with this appeal, arrangements are being made to have a further medical examination carried out by a different medical referee on 24 February 1992.

When the report on this examination is available a decision will be given on his entitlement to invalidity pension.
