Question:

124 Mr. Garland asked the Minister for the Marine the reason a company (details supplied) in Lough Swilly were licensed under the Fisheries (Consolidation) Act, 1959 and not the 1980 Act; when the licence was applied for; and when it was issued.

The granting of a fish culture licence under the terms of the Fisheries (Consolidation) Act, 1959, to the company to which the Deputy refers was the most suitable legal mechanism in the particular situation having regard to the various mechanisms available under the Fisheries Acts to license fish farming operations.

The company applied for a licence in 1985, which was granted in 1989. In addition, the company was granted a licence to moor structures at the site in question under the Foreshore Act, 1933, in 1986.
