Question:

102 Mr. Finucane asked the Minister for Education when payment will be made to teachers in a school (details supplied) in County Limerick as the excessive delay is causing further hardship to the two teachers involved; and if he will make a statement on the matter.

The school in question was given sanction by my Department to fill two vacancies on 6 March 1991 and 23 March 1991 respectively subject to the conditions of Rule 97 of the Rules for National Schools being adhered to. Rule 97 stipulates that any vacancy arising must be filled from the appropriate diocesan panel of redundant teachers if there is a teacher on that panel.

As there is a teacher currently on the Limerick diocesan panel, the board of management of the school are obliged to offer one of the vacancies in the school to her.

Approval of the appointment for temporary teachers cannot be considered in circumstances where a surplus teacher continues to be paid salary by the Department while on the panel and where the board of management has not taken steps to fill the vacancy from the panel.
