166 Mr. Sherlock asked the Minister for Justice if the Garda inquiry into the circumstances in which a blood sample from a serious road accident in Cork in July, 1991 was apparently deliberately damaged in the course of its transmission by registered post from Fermoy Garda station to the Medical Bureau of Road Safety, which he told Dáil Éireann on 16 October 1991 was under way, has yet been completed; if he will outline the findings of the inquiry; if any action has been taken as a result of the inquiry; and if he will make a statement on the matter.

I am informed by the Garda authorities that the internal Garda investigation in the case concerned has been completed and a file forwarded to the Director of Public Prosecutions.

The DPP has directed that two persons be charged arising from evidence given in the court proceedings concerning the traffic accident in this case. As regards the alleged unlawful interference with the blood sample, the DPP has said that there is no evidence which would support any criminal proceedings against any person.
