Written Answers. - Reinstatement of Former Public Servant.

Question:

54 Mrs. Owen asked the Minister for Finance if he will investigate the possibility of restoring a former public servant (details supplied) in County Dublin to her job in the public service as she was forced to leave due to the marriage bar.

The only basis in law for reinstatement is contained in section 11 of the Civil Service Regulation Act, 1956, as amended by the Civil Service (Employment of Married Women) Act, 1973, a copy of which is attached for your convenience.

As you may be aware, certain aspects of the provisions governing reinstatement — as contained in section 11 of the Civil Service Regulation act, 1956 (as amended) — have been challenged by the Employment Equality Agency and investigated by an Equality Officer of the Labour Relations Commission. The matter is currently under appeal in the Labour Court.

If the woman (details supplied) wishes to make an application for reinstatement under the terms of section 11 of the Civil Service Regulation Act, 1956 (as amended) she should contact the Personnel Section of the Department of Tourism, Transport and Communications, who will advise her where to direct her application. As she was an employee of the Department of Posts and Telegraphs at the time of her resignation, her application may be proper to An Post, Telecom or the Department of Tourism, Transport and Communications.
