Question:

113 Mr. Deenihan asked the Minister for the Marine if he has any plans to amend section 327 of the Fisheries Consolidation Act, 1959 which refers to the right of the individual owner to take materials from streams; and if he will make a statement on the matter.

Section 327 of the Fisheries Consolidation) Act, 1959 provides that "Nothing in this Act shall prejudice the right of any owner thereof to take materials from any stream".

I am aware of growing concern that the removal of gravel etc. from streams may be having an adverse impact on spawning beds and damaging fish stocks in inland waters.

My Department is examining the scale of the problem and also the scope for possible legal remedies including changes in legislation.
