Question:

133 Mr. Dukes asked the Minister for Justice if his attention has been drawn to the fact that in some parts of County Kildare, gardaí are prosecuting publicans who have licence extensions until 1 a.m., for functions which continue up to 2 a.m., simply because customers who are in their premises until the later time continue to consume alcoholic beverages served before 1 a.m.

As Minister for Justice I have no function in relation to the institution of prosecutions by the Garda.

The Garda Authorities have informed me that no prosecutions have been instituted in County Kildare in which the circumstances would coincide with those outlined in the question.
