Written Answers. - Proposed Road Traffic Bill.

Question:

23 Mr. Yates asked the Minister for the Environment if he intends to honour the promise made by his predecessor in a letter on 8 June 1991, to the Irish Road Haulage Association that legislation would be introduced in a new road traffic Bill to make the consignor of a load liable to prosecution for overloading; and if he will make a statement on the matter.

In June, 1989, the Irish Road Haulage Association was informed that consideration would be given to the question of amending the Road Traffic Acts to provide that the consignor of a load would, in addition to the driver and the owner of the vehicle, be liable for prosecution for offences of overloading vehicles. The matter has since been examined in some detail and, in recent months, has been the subject of correspondence and discussions between my Department and the Association. I am reviewing the position in the light of those discussions, and with due regard to the practical difficulties which would arise in the implementation and enforcement of a provision of the kind in question.
