Vol. 421 No. 4

Written Answers. - Employment Regulations for Spanish Citizen.

Ned O'Keeffe

Question:

316 Mr. E. O'Keeffe asked the Minister for Labour if a Spanish citizen (details supplied) residing in this country, can legally become employed here.

A non-national who has full citizenship of an EC member state may, in general, seek and take up employment in Ireland on the same basis as Irish nationals and would not require a work permit.

In the case of non-EC nationals, an employer must obtain a work permit from my Department before employing such a person.

On the basis of the information supplied by the Deputy, I understand that it is unlikely that the person in question, who now holds a passport from a non-EC country, is currently a full citizen of an EC member state. Accordingly, a prospective employer of this person would have to obtain a work permit in advance.

It is illegal for a non-EC citizen to be employed in the State unless a work permit has been granted beforehand.
