Vol. 422 No. 5

Written Answers. - Property Liability.

Mervyn Taylor

Question:

57 Mr. Taylor asked the Minister for Agriculture and Food if he has had discussions with the Minister for Justice concerning the fears expressed by landowners regarding third party risks during trespass on their properties; and if he will make a statement on the matter.

The Government are aware of the concerns of the farming community in relation to third party risks during trespass on their properties. This area of law is complex and involves a wide range of interests, some conflicting. As has already been indicated by my colleague, the Minister for Justice, the Attorney General has decided to refer the matter to the Law Reform Commission for examination and report. That is a desirable first step towards the formulation of new legislation in this area because of the many interests involved who need to be consulted and have their views taken into account.

I have had no discussions of the kind referred to by the Deputy.
