Written Answers. - Protection of Inner City Communities.

354 Mr. J. Mitchell asked the Minister for the Environment if, in view of the widespread concern which has arisen from a proposal to refurbish Temple Buildings, Dublin 7 especially in relation to the protection of the position of existing residents and to the protection of an existing inner city community, he will outline the steps which are currently open to him or what steps he will introduce to protect inner city communities in a similar position; and if he will make a statement on the matter.

As these dwellings are in private ownership, the rights of the tenants are, in the first place, determined by reference to the terms of the lease or other tenancy agreement under which the tenancies are held. Tenants of any dwellings formerly controlled under the Rent Restrictions Acts, have their right of tenure protected under the provisions of the Housing (Private Rented Dwellings) Act, 1982. Tenants of dwellings, not subject to the provisions of the 1982 Act, may, in certain circumstances, have tenure rights under the landlord and tenant code which is the responsibility of the Minister for Justice. I have no proposal to introduce any further measures in relation to tenure rights in private rented accommodation.
