Question:

73 Mr. Gilmore asked the Minister for the Environment the plans, if any, he has to amend planning regulations so that restaurant use is not an exempt development under a retail zoning.

The use as a restaurant of premises not previously used for retail purposes would require planning permission. However, a change of use from a shop to a restaurant, other than a fried fish shop or a shop for the sale of hot food for consumption off the premises, is, subject to certain limitations, exempted development by virtue of Class I of Part IV of the Third Schedule to the Local Government (Planning and Development) Regulations, 1977. The exempted development provisions of these regulations are being examined at present as part of a general review of the Regulations which is in progress in my Department.
