Question:

148 Mr. Connaughton asked the Minister for Labour the reason a person (details supplied) in County Galway who was a temporary ambulance driver with the Western Health Board is not entitled to a redundancy payment; and if he will make a statement on the matter.

It is a matter for the employer to decide, in the first instance, whether a dismissed employee should be paid a redundancy lump sum payment.

I understand that the question of the entitlement of the employee in this case to a statutory redundancy payment is under examination by his former employer, the Western Health Board. If the person concerned is dissatisfied with the employer's decision, it will be open to him to appeal that decision to the Employment Appeals Tribunal (Form RP51A — available from my Department — may be used for this purpose).
