308 Mr. J. Bruton asked the Minister for the Marine if Delegation of Function Orders have been made or will be made in respect of the Ministers of State at his Department; and if he will make a statement on the matter.

Question:

309 Proinsias De Rossa asked the Minister for the Marine if all Ministers of State at his Department have been given clear indications of their areas of responsibility; and if he will make a statement on the matter.

I propose to take Questions Nos. 308 and 309 together.

Yes. At its meeting on 9 February 1993 the Government made an Order entitled the Marine (Delegation of Ministerial Functions) Order, 1993. The effect of this Order is to delegate to the Minister of State at my Department the powers and duties of the Minister for the Marine under the following Acts:—

Fisheries Acts, 1959 to 1991, in so far as they relate to inland fisheries

Merchant Shipping Acts, 1894 to 1992

Mercantile Marine Act, 1955 (No. 29 of 1955)

Pilotage Act, 1913

Harbours (Regulation of Rates) Act, 1934 (No. 2 of 1934)

Harbours Acts, 1946 to 1976.

Fishery Harbour Centres Act, 1968 (No. 18 of 1968)
Free Ports Act, 1986 (No. 6 of 1986).
As the Deputy will be aware, this is a partnership Government and the philosophy of partnership will inform my relationship with the Minister of State and the conduct of the business of the Department of the Marine.
