Written Answers. - Miscarriages of Justice Claims.

Question:

88 Mr. Costello asked the Minister for Justice if, in the light of the commitment in the Programme for a Partnership Government 1993-1997 to introduce legislation to provide for a statutory right to compensation for victims of miscarriages of justice, she will give the criteria used at present in assessing the appropriate level of compensation to be paid to victims of miscarriages of justice pending the introduction of such legislation; and if, having regard to the terms of the reservation entered by Ireland to Article 14 of the United Nations Covenant on Civil and Political Rights, she will outline the administrative procedures which exist.

The procedure which is in place for the administrative settlement on miscarriage of justice claims is that the State appoints Counsel to negotiate the matter with the legal representatives of the claimants(s) within an agreed negotiating framework.
