Question:

125 Mr. Sargent asked the Minister for the Environment the procedure for appealing a public authority's decision in accordance with EC Directive 90/313/EEC.

, Wexford): Under Article 4 of the Directive, a person who considers his request for information has been unreasonably refused or ignored, or has been inadequately answered by a public authority, may seek a judicial or administrative review of the decision in accordance with the relevant national legal system. It is not intended to vary this provision when transposing the directive into Irish law. For example, an administrative review could be carried out by the Ombudsman in relation to public authorities coming under his jurisdiction, or a judicial review could be sought in the courts.
