Written Answers. - Army Disability Pension.

Question:

106 Mr. G. Mitchell asked the Minister for Defence if he will re-examine the case of a person (details supplied) in Dublin 12 who has been granted a temporary award of disability pension from the date on which he was examined by the Army Pensions Board; the reason the award was not granted from the date of application; and if payments for the interim period will be made.

Following his discharge from the Permanent Defence Force in 1973, the person in question was granted a disability pension under the Army Pensions Acts based on a degree of disablement of 20 per cent. The pension has been in payment since December, 1973.

In late 1992, he applied to have his case reviewed in the light of medical evidence furnished by him. He was re-examined on the 15 January, 1993, by the Army Pensions Board (which is the statutory body appointed under the Army Pensions Acts to adjudicate on such cases) and his degree of disablement was reassessed at 30 per cent. In accordance with the relevant statutory provisions, his disability pension was duly increased to the level appropriate to the higher degree of disablement and the increase took effect from the date of his re-examination by the Board. Payment of pension at the higher rate commenced in February, 1993, when arrears due were also paid.
