Written Answers. - Transfer of Milk Quota.

Question:

99 Mr. Finucane asked the Minister for Agriculture, Food and Forestry if he will clarify the situation regarding a farmer who has built up a quota prior to 1983 on rented land; the position if he wishes to transfer the quota to a member of the family; and if he will make a statement on the matter as the farmer is anxious to regularise his position now that he is approaching pension age.

Under EC law, milk quotas are attached to land and are automatically transferred when the lands to which the quota is attached are transferred. However, there are provisions in the relevant regulations whereby in certain circumstances a producer who has established quota on lands which he did not own may be entitled to have all or part of the quota transferred to his benefit for use on another holding.
