Question:

139 Proinsias De Rossa asked the Minister for Justice the guidelines for the acceptance of individual claims laid down by the Criminal Injuries Tribunal; the access to appeal available in the event of an individual declining an offer by the tribunal; and if she will make a statement on the matter.

The guidelines under which the Criminal Injuries Compensation Tribunal accepts and determines individual applications and the appeal procedures to be operated by the Tribunal are contained in the Scheme of Compensation for Personal Injuries Criminally Inflicted which was laid before the House of the Oireachtas in February 1974 and which was amended with effect from 1 April 1986. The amended scheme was laid before the Houses of the Oireachtas in March 1986.

The Tribunal also operates the Scheme of Compensation for Personal Injuries Criminally Inflicted on Prison Officers which was laid before the Houses of the Oireachtas in May 1990.
